The appeal process has four levels, including:

  • Reconsideration
  • Hearing by an administrative law judge
  • Review by the Appeals Council

The first step to your appeal is the “Reconsideration” level. To begin the appeal, you’ll need to complete a Request for Reconsideration, Form SSA-561. You can also start your appeal online through the Social Security website.

What conditions qualify to receive Veterans Disability?

If you have a current physical condition that results from an accident, injury, or illness during your time in service, you might be eligible to receive service-connected veterans disability benefits or veterans compensation.

If you have a current severe mental condition that in any way results from your time in service, you could be eligible to receive service-connected veterans’ disability benefits or veterans compensation. This includes Post-traumatic Stress Disorder (PTSD), but of course, numerous mental conditions could be applicable.

If you have a current condition, physical or mental, which pre-dates your time in service and which was aggravated while in service, you might also be eligible for service-connected benefits.

There are different rules for compensation depending on various factors, such as for Prisoner of War (POW) and Gulf War Veterans and for radiation exposure. Please see [Additional information provided in] the Herren Law

What is the difference between Veterans Compensation and Veterans Pension?

Veterans Compensation is a benefit paid for conditions that result either directly or indirectly from injuries or illnesses sustained while in service; diagnosis while in service is not required for eligibility (often referred to as service-connected or S/C).

Veterans Pension benefits are available to some veterans with disabilities that are not service connected and who have financial need. (Often referred to as non-service connected or NSC)
